If you complete a membership agreement or sign up for a fitness event, we also collect information that you provide about any health conditions that could affect your ability to participate in a workout. If you do not provide this information, you will not be able to create an online account, complete a membership agreement, or book a class.

For example, we use your information, such as your email address, to send you news and newsletters, special offers and promotions, or to otherwise contact you about products, services, workout sessions, or other information to provide a more personalized experience.
• We use your information (typically in the aggregate) to assist us in advertising the sit and stay fit Fitness brand on unaffiliated websites and in evaluating the success of our adverting campaigns (including our online targeted advertising and offline promotional campaigns).
• To better understand how users access and use our Site, both on an aggregated and individualized basis, in order to improve our Site and respond to user desires and preferences, and for other research and analytical purposes.
• To administer our membership reward program if applicable.
• To administer surveys and questionnaires, such as for market research or member satisfaction purposes.
• If sit and stay fit becomes a franchise or is involved in a merger, acquisition, or any form of sale of some or all of its assets, we will provide notice before personal information is transferred and becomes subject to a different privacy policy.

• group sessions. During a group session, participants may share their name with other session participants. You may also share information about your workouts and challenges you participate in with your social media accounts or Private Facebook Groups.
• service providers. We disclose the information we collect from you to our vendors, service providers, contractors, and agents who perform functions on our behalf. In particular, the workout sign-up portal is hosted by SiteGround; As noted above, the third party scheduling tool will capture your information as well and your details may be disclosed for the purposes of verification.

We also disclose information in the following circumstances:

• business transfers. If (i) we or our affiliates are or may be acquired by, merged with, or invested in by another company, or (ii) if any of our assets are or may be transferred to another company, whether as part of a bankruptcy or insolvency proceeding or otherwise, we may transfer the information we have collected from you to the other company. As part of the business transfer process, we will share certain of your personal information with lenders, auditors, and advisors, including attorneys and consultants.
• in response to legal process. We also may disclose the information we collect from you in order to comply with the law, a judicial proceeding, or other legal process, such as in response to a court order or a subpoena.

We and our service providers use cookies and other tracking mechanisms to track information about your use of our Site. We may combine this information with other personal information we collect from you (and our service providers may do so on our behalf).

sit and stay fit also may participate in co-branding and other relationships to offer e-commerce and other services and features to its users. However, even if the third party is affiliated with sit and stay fit, we have no control over these linked sites, each of who have separate privacy and data collection practices independent of sit and stay fit. We have no responsibility or liability for these independent sites’ policies or actions, and are not responsible for the privacy practices or the content of any such web sites. Please make sure you are comfortable with the privacy practices of every site you visit before providing the site with your personal information. These linked sites are only for your convenience and you therefore access them at your own risk.

We also may make chat rooms, forums and message boards available to you on the Website. We do not, however, monitor the chat rooms, forums or message boards, do not moderate them, and you agree that we have no obligation to do so. We cannot and do not control the information that is shared by members. Anything you voluntarily provide in any public area of the Internet will be publicly available to other visitors on that web site and potentially to other third parties. You should exercise caution when deciding to publicly disclose any of your personal information in these and similar areas. Members can join a private Facebook Group which will be moderated.

We have implemented reasonable precautions to protect the information we collect from loss, misuse, and unauthorized access, disclosure, alteration, and destruction. Please be aware that despite our efforts, no data security measures can guarantee security.

We are not responsible for any lost, stolen, or compromised passwords or for any activity on your account via unauthorized password activity.

You may modify personal information that you have submitted by logging into your account and updating your profile information. Please note that copies of information that you have updated, modified, or deleted may remain viewable in cached and archived pages of the Site or App for a period of time.

At any time, but only once per calendar year, or as otherwise required under applicable law, users may contact sit and stay fit to review the personally identifiable information that sit and stay fit has collected about you. If you discover any errors, please notify sit and stay fit and the information will be corrected. To review the personally identifiable information that company has collected about you, please send an email to info@sitandstayfit.com with the subject line: “Personal Information Review Request.” Users may also request that sit and stay fit delete a user account(s) or, if you have not established a user account, your email address, and any related data at any time. You may also choose to confirm that the sit and stay fit does not use your personal information in certain ways and/or to otherwise “opt out” of certain uses of that personal information, including without limitation (i) when your personal may to be disclosed to a third party unrelated to the sit and stay fit and/or parties directly related to providing your Services and/or (ii) when your personal information may be used for a purpose that is materially different from the purpose(s) for which it was originally collected or subsequently authorized by you. 8. what choices do i have regarding promotional communications?

In accordance with applicable law, we will send periodic promotional communications to you. You may opt-out of such communications by following the opt-out instructions contained in the communication, or if you have opted-in to our promotional text messages, replying STOP. We will process opt-out requests in accordance with applicable law. If you opt-out of receiving promotional communications about recommendations or other information we think may interest you, we may still send you communications about your account or any services you have requested or received from us.

9. children under 16

Our Site, Apps, and services are not designed for children under the age of 16. If we discover that a child under the age of 16 has provided us with personal information, we will delete such information from our systems.

The Company nonetheless encourages parents to go online with their kids. Here are a few tips to help make a child’s online experience safer:

• Teach kids never to give personal information, unless supervised by a parent or responsible adult. Includes name, address, phone, school, etc.
• Know the sites your kids are visiting and which sites are appropriate.

sit and stay fit regularly reviews compliance with this Policy. Please feel free to contact us with any questions or concerns regarding this Policy or sit and stay fit's treatment of personal information. When we receive formal written complaints, it is our practice to contact the complaining user regarding his or her concerns. We will cooperate with the appropriate regulatory authorities, including domestic data protection authorities, to resolve any complaints regarding the transfer of personal data that cannot be resolved between sit and stay fit and an individual.

Neither the Company nor the Site knowingly permit the use of malware, spyware, viruses, and/or other similar types of software.

13. transfer of information across national borders

Our site and various information we collect are operated on servers located in various jurisdictions, including the United States. When you access or use the Site and/or our services, personal information about you may be transferred outside the country in which you are situated to these other locations. The Company’s policies ensure that such personal information is protected to the same standard when processed by any Company entity or office around the world. We also ensure that appropriate contracts containing standard data protection clauses approved by the European Commission to protect that information and the rights of individuals are in place with any and all third-party service providers we may use.

Under the California Shine The Light law, California residents have the right to request from us a list of all third parties to which we have disclosed personal information during the preceding year for direct marketing purposes.
